Terms and Conditions

This page outlines the terms of using Medad services, the rights of both the user and the platform, and the mechanisms for subscription, payment, cancellation, and refunds.

Please read and accept all provisions contained in the Terms of Use and Privacy Policy before using Medad services.

Introduction to Terms of Use

Subscribing to Medad services via the website or application requires agreement to the terms of use stated on this page.

Services provided by Medad include all products, features, and tools available through the website or the platform's app.

The same terms apply to any new features or services added to the Medad platform in the future, and continued use of the service constitutes implicit acceptance of any changes.

Medad reserves the right to update these terms at any time in accordance with operational and regulatory updates, and the user bears the responsibility to review these updates.

Please read and agree to all terms stated in the Terms of Use and Privacy Policy before starting to use Medad services.

Account Terms

The user must reach the minimum legal age applicable in the Kingdom of Saudi Arabia to create an account on Medad.

  1. The user has the right to create a new account or cancel their current account in accordance with Medad's approved subscription and cancellation procedures.
  2. The user agrees to receive phone messages and emails from Medad for operational and communication purposes related to the services.
  3. The user bears full responsibility for maintaining the confidentiality of their account password and not disclosing it to any third party.
  4. The user assumes full responsibility for all activities occurring through their account, including uploaded files and data.
  5. Medad reserves the right to terminate service and suspend the account if any violation of the terms of use is proven, without prior notice.
  6. Medad retains the right to determine account ownership based on registered information, and no party may claim ownership without official proof.
  7. The user is permitted to subscribe to Medad on behalf of their employer, provided they are officially authorized by the employer.

General Provisions

  1. Communication with the Medad support team is conducted through the official approved channels specified on the website.
  2. This agreement is subject to the laws and regulations in force in the Kingdom of Saudi Arabia.
  3. Medad reserves the right to amend these terms at any time, and users will be notified of material changes via email.
  4. Changes to the terms of use take effect from the date of their publication on the website unless another date is specified.
  5. It is prohibited to use the service for any illegal purpose or in violation of applicable laws and regulations in the Kingdom.
  6. Reselling, cloning, or distributing the service is not allowed without prior written permission from Medad.
  7. The Privacy Policy is an integral part of the Terms of Use and is subject to the same provisions.
  8. In the event of a conflict between the Arabic and English versions of these terms, the Arabic version shall be the official reference.

Medad's Rights

  1. Medad has the right to modify, suspend, or terminate the service in whole or in part at any time, taking into account the interests of paid plan subscribers.
  2. Medad reserves the right to refuse the activation of an account for any entity or user without stating reasons.
  3. In the event of a dispute over account ownership among multiple parties, Medad reserves the right to freeze the account until the dispute is settled.
  4. Medad may request official documented papers to prove account ownership when there is a dispute or request for ownership transfer.
  5. Medad has the right to temporarily suspend the account while resolving any disputes regarding ownership or access permissions.

Limitation of Liability

Medad provides its services on an "as is" basis without any express or implied warranties.

In no event shall Medad be liable for direct, indirect, incidental, or special damages arising from the use of or inability to use the service.

The user agrees to indemnify Medad, its employees, officers, partners, and agents against any claims, losses, damages, or expenses, including attorneys' fees, arising from their use of the service in violation of these terms or in violation of third-party rights.

No limitations or exclusions in these terms shall exempt Medad from mandatory legal liabilities that cannot be waived under applicable regulations.

Waiver & Entire Agreement

This document constitutes the entire agreement between the user and Medad regarding the use of the service, superseding all prior agreements and understandings, whether oral or written.

Medad's failure to exercise or enforce any right in a specific incident does not constitute a permanent waiver of that right in future similar incidents.

If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Payment of Fees

  1. Subscription fees for Medad services are determined according to the chosen package, displayed on the website, and may change with prior notice.
  2. The annual maintenance contract for the Medad Desktop system includes technical support and updates during the paid subscription period.
  3. Corporate accounts can pay subscription fees via credit card or an approved bank account.
  4. All fees are calculated in Saudi Riyals (SAR) unless explicitly stated otherwise.
  5. Subscription fees are paid in advance according to the selected cycle (monthly or annual) before accessing the service.
  6. The user has the right to file a complaint regarding any invoice within thirty (30) days of its issuance, and complaints will not be accepted after this period.
  7. Prepaid fees are non-refundable except according to Medad's approved refund policy set forth in these terms.

Auto-Renewal

  1. Subscriptions automatically renew at the end of each billing period unless canceled by the user prior to the renewal date.
  2. Medad notifies the subscriber of the automatic renewal date via the registered account email before the renewal date.
  3. If renewal fees cannot be collected, Medad reserves the right to suspend user access to the service until payment is completed.

Cancellation & Termination

The user has the right to cancel their subscription at any time through the account settings in the dashboard or by contacting the support team.

Upon subscription cancellation or termination, the following consequences apply:

  • User access to the service continues until the end of the current paid period without interruption.
  • Subscription fees will not automatically renew after the cancellation date.
  • The user will no longer be able to access data stored on the system after the subscription period ends.
  • The user must export and back up their data before the subscription period expires to ensure retention.

Refund Policy

Refund Steps

  1. The user submits a refund request through Medad's official support channels, stating the reason for the request.
  2. The Medad team reviews the refund request and verifies its eligibility within seven (7) business days from the request date.
  3. If accepted, fees for services actually used will be deducted from the total refunded amount per the approved policy.
  4. The refunded amount will be transferred to the original payment method used within fourteen (14) business days of approval.
  5. Refund requests will not be accepted after the specified refund period or after the renewal period has passed for the subscription.

Annual Subscriptions

A grace period is provided for annual subscription renewals, during which the user retains limited access to their data under the following conditions:

  1. The grace period begins immediately after the annual subscription expires and lasts for the duration specified by Medad based on the package type.
  2. The user retains read-only access to view data during the grace period without the ability to record transactions or make edits.
  3. The user will not be able to access the system or their data after the grace period ends without renewing the subscription or executing a new agreement.

Applications

Regarding refunds for subscriptions made via third-party applications:

  • Fees for app purchases made via external app stores are non-refundable through Medad and are subject to each respective store's refund policy.
  • Medad's refund policy stated in these terms applies to subscriptions sold directly via Medad's website.
  • In case of conflict between an app store's policy and Medad's policy, the relevant store policy takes precedence regarding app fees.

Modifications to Service & Prices

  1. Medad reserves the right to modify subscription prices at any time, and current subscribers will be notified prior to their first affected renewal date.
  2. Price change notifications will be sent via the registered account email well before the renewal date to allow users time to decide.
  3. Medad reserves the right to modify or suspend any part of the provided services for operational, technical, or legal reasons, without incurring any compensation liability exceeding the remaining subscription fee period.
